Brief introduction of the seminar 

Ernst & Young cordially invites you to attend our seminar on "Transfer Pricing challenges in Mainland China and the impact on Hong Kong" to be held in Hong Kong on 12 October 2009.

The seminar will be divided into two separate segments. The morning will deal with Asia-Pacific regional transfer pricing issues in the financial services sector, with particular focus on China-based private equity sector and renminbi (RMB) fund opportunities. The afternoon session will cover all industries and will focus on the broader Mainland China and Hong Kong transfer pricing issues, particularly challenges associated with documentation requirements.

The morning discussion on RMB funds will examine the transfer pricing considerations surrounding some of the proposed structures currently in place for such funds, including practical considerations around the benchmarking of data sources and potential permanent establishment triggers.

The afternoon session will cover recent updates concerning the Mainland China transfer pricing documentation requirements and the recent release of Circulars 85 and 114, as well as interpretations of Circular 363; discussions around the advantages and disadvantages of the new Advance Pricing Agreement rules in Mainland China; and advice on dealing with the tax bureaus in Southern China. We will also discuss the changing environment of Hong Kong transfer pricing in the context of the impact of Mainland China's rules and the Double Taxation Agreement between Mainland China and Hong Kong, as well as present case studies for discussion on the recent Inland Revenue Department challenges using transfer pricing.

This seminar is designed for taxation, finance and accounting executives of corporate groups with related party transactions in Hong Kong and Mainland China. The morning session is specifically designed for such executives in the financial services sector.
