Anti-tax avoidance rules and special tax inspection in mainland China

The general anti-tax avoidance rules were first introduced in mainland China under the new Corporate Income Tax Law in 2008.  A series of tax circulars have subsequently been issued by the mainland China tax authorities in strengthening the administration and implementation such as Guoshuifa [2009] No. 2 - the Implementation Measures for Special Tax Adjustments, Guoshuihan [2009] No. 601 in setting out guidelines on interpretation and determination of "Beneficial Ownership", Guoshuihan [2009] No. 698 in providing further guidance on Corporate Income Tax administration on gains from equity sales derived by non-residents, etc.  The tax authorities have since then become more sophisticated in enforcement of the rules.

In addition, with the objective to further regulate the annual tax special inspection, the State Administration of Taxation has selected certain industries, enterprises or individuals in specific industries or activities as instructional or recommended inspection targets.  Taxpayers are confronting a changing tax environment and need to stay vigilant in assessing their mainland China tax risk.
