Ukraine's President signs Transfer Pricing Law, effective from 1 September 2013

On 31 July 2013, the President of Ukraine signed the comprehensive Law on Transfer Pricing (the TP Law).1

The TP Law introduces the definition of related parties and controlled transactions. It also provides for a detailed description of five TP methods, based on the OECD Guidelines, and introduces strict compliance and documentation requirements, along with a number of other important changes.

The TP Law comes into force on 1 September 2013.

According to the TP Law, Ukrainian companies will have to file their first TP report on controlled transactions by 1 May 2014. The tax authorities can start requesting and auditing TP documentation for 2013 from taxpayers on 1 May as well.
