This ground-breaking research by Ernst & Young led Mr. Justice Frank Clarke to suggest the need for best practice guides to steer the Irish legal community through the electronic element of discovery, to allude to the need for possible rule changes, and to hint at future costs penalties for not considering electronic evidence.
