2013 South Africa Budget

Finance Minister Pravin Gordhan presented today a budget speech on behalf of President Zuma’s administration.  In spite of the challenges faced by developed countries throughout the world, Minister Gordhan pointed out that South Africa’s economic outlook is improving, but added a few words of caution. 

The budget has been built on an assumption that the economic growth will be steady and continue to grow modestly over the next few years.  He notes that this growth is critical for the creation of jobs, which is the highest priority of the administration. 

Rather than raising personal and business income taxes, the budget shows not only restraint against the increase in spend, but provides tax relieve of R 7 billion for the majority of South Africa households. 
In an effort to stimulate business growth, Minister Gordhan highlighted the impact of the substantial infrastructure expenditure which should lead to a real and sustained step up in the establishment of private sector jobs.  To further encourage the creation of jobs, he announced initiatives for employers to take on young employees.

We noted closely the comments around the administration will look at expanding programs designed to attract new investment and job creation.  In addition to these financial support programs, he noted that there is a need to relax cross-border financial regulations and tax requirements on companies, to improve South Africa’s standing as the premier regional headquarters location for investment.  He went on to mention that similar measures will apply to foreign companies as well, thus continuing to make South Africa attractive as a major investment destination for regional headquarters.

Lastly, he left open the possibilities of increasing taxes to support the government if economic growth weakens.  One would not be cynical to assume that there is a significant tax agenda already under development.

We noted the positive notes around Commissioner Oupa Magashula and the staff of the South African Revenue Service for their contribution through improved compliance and enforcement.

We also know that a tax commission will be formed later this year for a review of South Africa’s tax policy framework and its role in supporting the objectives of inclusive growth, employment, development and fiscal sustainability. 

We believe businesses need to keep a close eye tax policy debate that will begin shortly!

In closing, commentators are stating that there were few surprises in the budget.  We take a different view.  We believe that the budget shows a strong understanding of the fragility of the current economic state, the need to provide policies that support job growth and the need to provide support for businesses to remain competitive and invest in South Africa.

We see the upcoming year presents challenges for businesses, but we see greater opportunities to the engaged businesses looking for support utilising a number of economic incentives and regulatory changes that should help businesses increase their competitiveness in South Africa.

Mindful of the overwhelming need to achieve growth in order to reverse the disappointing lack of meaningful job creation, (while continuing to maintain fiscal discipline), the Minister has set what we believe to be a balanced course with meaningful stimulus measures, limited and defensible tax increases, and reasonably restrained expenditures. Interestingly, he emphasised, once again, the need for competence, integrity and accountability throughout the civil service. The emphasis seemed more pronounced this year and probably reflects a widespread frustration that appeals made in Parliament do not necessarily translate to concrete actions on the ground. We fully endorse this push and look forward to a time when taxpayers believe that taxes paid will be productively spent.

Major economic indicators
A growth rate of 2.5% was achieved over the year, woefully inadequate for the purposes of making inroads into unemployment, and disappointing in the context of global growth of about 3.6% and sub-Saharan Africa at 5.7%. Growth is projected to improve marginally to 2.7% in 2014 and to about 3.8% in 2015. Poor export demand in our major trading partners, particularly the EU, coupled with an exceptionally fractious year in labour markets, led to poorer perceptions abroad, reduced confidence locally, and downgrades by the rating agencies.

Inflation at 5.7% remains just within the targeted range of 3% – 6%; food price inflation remains a significant contributor, and the weakening of the Rand has led to upward pressure on consumer prices , including the petrol price.

What is Global Compliance and Reporting?

Managing the risks of mobile employees

While optimizing the competitive advantage of your people has long been a core objective, a more recent set of trends in the tax landscape means that large companies with an internationally mobile workforce are at a higher risk of tax noncompliance and resulting controversy than ever before.

The business and tax landscapes that have changed so much over the last few years continue to shift. The pace of globalization is increasing, and the global financial crisis has acted as a catalyst to both globalization and business transformation, with many emerging markets now seeing faster growth than before the crisis.

Alongside these megatrends, a variety of underlying issues are converging, resulting in a growing set of risks for multinationals who have globally mobile employees. While companies may closely define and execute their formal expatriate assignment policies, business travelers outside the scope of such formal policies are widely accepted to be creating a new set of risks for companies to manage.

Unintended tax compliance obligations

These travelers are increasingly creating unintended tax compliance obligations, and the resulting risks are not just personal. They are increasingly felt at the corporate level, with the corporate tax function often unaware of the extent of the spreading problem. Tax administrations are becoming increasingly aware of the issue, however, and are very effectively using new technology to identify where a tax obligation has arisen. In a rising tax enforcement landscape, this issue has significant potential to grow.

Managing these risks should be a burning platform issue for multinational companies.

A burning platform?

What may start as a relatively simple personal income tax compliance issue can quickly create a ripple effect, with risks such as the creation of a permanent establishment, an employment tax audit or the payment of a significant related penalty all occurring at the corporate level.

At the same time, the pace of legislative change (such as the increasing enforcement of permanent establishment) is actually speeding up. Countries are using this type of legislation to increase overall levels of tax revenue.

As governments continue to look for ways to widen the tax base, they are likely to learn from one another in fora such as the OECD's Forum on Tax Administration, CIAT, CIOT and SGATAR and quickly replicate the processes and technologies used. As they do so, we will likely see penetration of this issue into a broader number of companies of smaller size.

Companies, recognizing the spectrum of reputational, personal and financial risks related to tax, are making strong efforts to be compliant. There is an increasing acceptance that such issues are becoming increasingly urgent from both a reputational and a financial perspective.
