Prominutí DPH u testů a vakcín proti COVID-19 - GFŘ zpřesňuje výklad

Jak jsme Vás již dříve informovali, GFŘ na začátku roku vydalo informaci, ve které vyjasňuje vybrané otázky související s prominutím DPH u dodání sad pro testování na onemocnění COVID-19 a dodání očkovacích látek proti tomuto onemocnění. Nyní GFŘ vydalo dodatek, ve kterém se vyjadřuje k některým nejasným aspektům.

Dodatek upřesňuje, že pro účely prominutí DPH postačuje, aby testovací sada byla použitelná pro testování na onemocnění COVID-19. Možná použitelnost testovací sady i na další onemocnění není na překážku prominutí DPH. Není nutné dokládat skutečné použití dodané testovací sady.

Dodatek dále upřesňuje postup při vystavování daňového dokladu. Původní informace měla poněkud zavádějící formulaci, že je dodavatel povinen vystavit daňový doklad a pokud na dokladu uvede „daň prominuta rozhodnutím MF“, tak doklad nemusí obsahovat sazbu daně a výši daně. V praxi to mohlo být vykládáno tak, že dodavatel má de facto volbu, zda uplatní prominutí DPH nebo odvede daň. Dodatek tento text upřesňuje tak, že DPH na dokladu nesmí být uvedena. Pokud by na dokladu byla částka DPH uvedena, vznikla by dodavateli povinnost tuto daň odvést, ale odběratel by i přesto neměl nárok na odpočet daně na vstupu. Výklad informace ve znění dodatku bude uplatňován od 1. března 2021. Text je tak uveden do souladu s jinou informací GFŘ k prominutí DPH u respirátorů.

Pro úplnost doplňujeme, že v současné době probíhají v odborné veřejnosti diskuse o tom, zda odběratel skutečně nemá nárok na odpočet DPH, pokud dodavatel v rozporu s prominutím DPH uplatní.

    VAT relief for test kits and COVID-19 vaccines - GFD refines interpretation 

    As we have already informed, at the beginning of the year the General Financial Directorate (GFD) issued a methodological information refining certain issues related to VAT relief for supplies of COVID-19 test kits and vaccines. Now, GFD issued a supplement addressing certain unclear aspects.

    The supplement is aimed at clarifying that for the purposes of VAT relief it would be sufficient for test kits to be applicable to COVID-19 disease testing. Possible applicability of the test kit to other diseases does not preclude the VAT relief. It is not necessary to prove the actual use of the test kit supplied.

    The supplement further refines the procedure of issuing tax documents. The original information had a somewhat misleading wording that the supplier is obliged to issue a tax document and if it states on the document “tax waived on grounds of Ministry of Finance decision” then the document does not need to include tax rate and tax amount. In practice, this could be interpreted as meaning that the supplier can de facto choose whether to apply a VAT waiver or pay tax. The supplement refines the text in terms that VAT must not be inserted on the tax document. Should the amount of VAT be entered on the document, the supplier would be obliged to pay that tax but the customer would still not be entitled to deduct input tax. The interpretation of the information as amended by the supplement will be applied from 1 March 2021 onwards. The text is aligned with another GFD information regarding VAT relief for respirators.

    For the sake of completeness, we add that there is currently a debate in the professional community about whether the customer is indeed not entitled to VAT deduction if the supplier, contrary to waiver, applies the VAT.
