The Advance Pricing Agreement (‘APA’) program was introduced in India in 2012 and is celebrating a decade of presence with a staggering number of applications (about 1,200) and significant conclusions (350+). This program has helped many companies to achieve certainty on their Transfer Pricing (‘TP’) aspects. The program has also boosted the “ease of doing business India” index and has successfully witnessed multiple bilateral APAs also with countries like USA, Japan, UK, Netherlands, Switzerland, Singapore and Australia.
The Annual Report 2017-18 by the Central Board of Direct Taxes (‘CBDT’) on APA covers an interesting fact that India’s conclusion speed is better than the advanced economies like USA.
