Commission Implementing Regulation (EU) 2024/3133:

A rectangular article, measuring approximately 185 cm × 132 cm, made up of a thick, densely woven, single coloured textile fabric of man-made fibres (100 % polyester) having the shape of a shell (which is designed to be filled) for a rectangular giant cushion (so-called bean bag). 

The article has wide hemmed edges along its sides. Four metal eyelets are attached to the four corners of the hemmed edges and another two metal eyelets are attached each to one of the two longer hemmed sides (approximately one quarter of the length of the side measured from the corner). 

The article has a zip opening to allow for filling. 

Two adjustable straps made of the same textile fabric as the main article and having a snap hook attached to each side are presented together with the article. The straps are designed to be fixed to the metal eyelets by means of their snap hooks, in order to raise part of the cushion.

6307 90 98

Classification is determined by general rules 1 and 6 for the interpretation of the Combined Nomenclature (GIR), Note 7 (f) to Section XI and by the wording of CN codes 6307, 6307 90 and 6307 90 98. 

 

Once the article is filled, due to its objective characteristics, it is similar to cushions. It is designed like a giant rectangular cushion and not as a seat of heading 9401 due to its instability (which makes it yield to the body weight and collapse when a user is leaning into it). Therefore, the filled article would be classified under CN code 9404 90 90 as articles of bedding and similar furnishing (for example, cushions, pouffes and pillows) by the application of GIR 1 and 6. However, classification of the unfilled, unfinished article under heading 9404 as articles of bedding and similar furnishing is excluded, because the article does not have the essential character of a complete article of heading 9404 within the meaning of GIR 2 (a). It is not yet stuffed or internally fitted with any material.

Given that the article is a shell for a giant cushion, classification under heading 6302 as bed linen is excluded, because the article does not have the objective characteristics and properties of bed linen of heading 6302. It is not covering a pillow or cushion like bed linen is. (See Commission Implementing Regulation (EU) 2024/966 (OJ L, 2024/966, 27.3.2024, ELI: http://data.europa.eu/eli/reg_impl/2024/966/oj). 

 

Given that the article cannot be classified in a heading that is more specific than heading 6307, it is therefore to be classified under CN code 6307 90 98 as other made-up article of textile fabrics

Commission Implementing Regulation (EU) 2024/3020: 

So-called pipette tips, made of translucent polypropylene plastics, of a cylindrical body with conical tip, of various diameters and lengths.

The pipette tips are interchangeable, disposable components which can be fitted in a pipetting apparatus and in automated dosing systems (dosing robots).

These products are designed to be used in various specific diagnostic and research applications to transfer small, precise amounts of liquids accurately and consistently.

3926 90 97

Classification is determined by general rules 1 and 6 for the interpretation of the Combined Nomenclature and by the wording of CN codes 3926, 3926 90 and 3926 90 97.

Although the pipette tips are suitable for use solely or principally with the pipetting apparatus and automated dosing systems of heading 8479 and they are significantly involved in the absorption and precise dosing of the liquid, they cannot be considered as parts of these apparatuses, as they are interchangeable and disposable components.

Moreover, while a pipetting apparatus or automated dosing system cannot carry out its function without the pipette tips, it is nevertheless established that the mechanical and electrical functioning of those machines is not dependent on the pipette tips. Consequently, classification under heading 8479, as parts of the pipetting apparatus is excluded. (See also judgment of the Court of Justice of the European Union of 19 July 2012 in Case C-336/11, Rohm & Haas Electronic Materials CMP Europe GmbH and Others, ECLI:EU:C:2012:500, paragraphs 35-39.)

Due to their objective characteristics, the products are to be classified according to their constituent material, under heading 3926, as articles of plastics.

The products are therefore to be classified under CN code 3926 90 97, as other articles of plastics.

Amendments to CN Explanatory Notes to CN subheadings covering: yogurt (C/2024/7254)

The Explanatory Notes to the Combined Nomenclature of the European Union are amended as follows: 

On page 38, in the Explanatory note to CN subheadings "0403 10 11 to 0403 10 99 Yogurt", the CN codes "0403 10 11 to 0403 10 99" are replaced with CN codes "0403 20 11 to 0403 20 99".

On page 39, in the Explanatory note to CN subheadings "0403 90 11 to 0403 90 99 Other", the first paragraph is replaced by the following:

  • The basic principle is that the construction/assembling itself is the main purpose of the toy

These subheadings do not include goods presented unassembled (GIR 2 [a]), for example, for packaging reasons, whose entertainment value is only given after assembling".

Amendments to CN Explanatory Notes to CN subheadings covering: transmission shaft, cranks, flywheels and pulleys (C/2024/7447)

The Explanatory Notes to the Combined Nomenclature of the European Union are amended as follows:

They do not transmit any power themselves, but maintain the tension of the track, transmit rotary movement, and as such act as a guide (see the HSEN to heading 8483, part (G) “Pulleys, including pulley blocks”, second paragraph)".
