Latest Indonesian TP regulations and newly released OECD guidelines on Pillar One Amount B

Gain comprehensive insights into the latest Indonesian transfer pricing (TP) regulation – Indonesian Minister of Finance Regulation 172/PMK.04/2022 (PMK 172) at this breakfast seminar. PMK 172 addresses the application of the arm’s length principle in Indonesia, TP documentation requirements, Advanced Pricing Agreements (APAs) and the Mutual Agreement Procedure (MAP). PMK 172 entered into force on 29 December 2023 and has revoked the prior Indonesian Ministry of Finance Regulations relating to TP documentation, MAP and APAs. Specific topics covered:

  • An overview of PMK-172 and the main changes from prior regulations.
  • Implications and considerations of PMK-172 on the determination of arm’s length pricing, TP documentation, the MAP, APAs and TP controversy.
  • Considerations and action steps in relation to fiscal year 2023 and fiscal year 2024 transfer pricing compliance.

Pillar One Amount B – Newly released OECD guidelines

On 19 February 2024, the Organisation for Economic Co-operation and Development (OECD) released the final report on Pillar One Amount B, which aims to simplify and streamline the application of the arm’s length principle to baseline marketing and distribution activities. Unlike other Base Erosion and Profit Shifting (BEPS) 2.0 measures, Pillar One Amount B is not subject to a revenue threshold and will be relevant for a wide range of multinational businesses.

The speakers will provide an overview of the final OECD report on Amount B and specifically cover the transactions within scope of Amount B, key design features of the pricing methodology and a discussion on the implications for companies operating in Singapore, including approach to streamlining the compliance process for Amount B through an appropriate operational TP framework.
