In June 2024, the Organisation for Economic Co-operation and Development (OECD) and G20 Inclusive Framework on Base Erosion and Profit Shifting (BEPS) released a new administrative guidance on the Global Anti-Base Erosion (GloBE) rules under Pillar Two, which addresses several technical issues under the GloBE rules. With Pillar Two now in effect in several major economies, it's imperative for in-scope multinational enterprise (MNE) groups to understand and comply with these rules.
Our session will focus on the following key technical issues set out in the OECD’s June 2024 administrative guidance, and discuss the implications of these issues and the possible strategic approaches to tax accounting in a post-GloBE landscape:
- The nuances of the Deferred Tax Liability (DTL) recapture rule (i.e. rule that seeks to remove the influence of DTLs that have been included in the jurisdictional effective tax rate (ETR) computation when the associated deferred tax remains “unpaid” after a five-year period).
- The alignment (or lack thereof) between GloBE and accounting carrying values, and the associated deferred tax asset or DTLs determined therefrom that affects the jurisdictional ETR computation.
