The procedure for obtaining the EORI number has changed

On August 23, 2023, in the Official Gazette no. 763 was published the Order no. 1760/2023 for approving technical Norms regarding registration in custom purposes for economic operators and other persons.

Among the most important provisions of the Order, we mention the following:

  • Economic operators that are established in Romania, no longer have the obligation to annex specific documents at the request for assignment a EORI number (for example the certificate of registration in VAT purposes);
  • The customs authorities will use some information/ data required for analyzing the request from the data bases of the public institutions, such as:
    • RECOM data base — online data base managed by National Trade Register Office;
    • VIES — the system for the exchange of information on value added tax (VAT Information Exchange System), implemented and managed by the European Commission;
    • ANAF data base — VAT Register — online data base managed by National Fiscal Administration Agency regarding the value added tax;
    • National ONG Register data base — online data base managed by the Ministry of Justice.
  • In the situation when one of the prior mentioned data bases does not work, the customs authority will request the document/documents that have to accompany the request from the person that has submitted the request, through the electronic mail or other ways of communication.
  • It has been introduced the concept of exceptional situation through which the request of attribution of a EORI number can be transmitted to:

             -   the interior customs office of the county seat in the case of persons established in Romania,

or

              -  at the customs office in whose territorial jurisdiction the applicant is to carry out his activity in case of the economic operators and other persons that are not established in the custom territory of the Union.
