The list of foreign individuals permitted to engage in employment without a work permit has been amended

Amendments to the List of Foreign Individuals Exempt from Foreign Labor Permit Requirements (Resolution No. 1041 dated November 24, 2023)

We hereby inform you that the Government of the Republic of Kazakhstan has adopted Resolution No. 635 dated August 18, 2025, introducing amendments to Resolution No. 1041 dated November 24, 2023, titled:

"On the determination of the list of individuals exempt from obtaining permits from local executive authorities for the engagement of foreign labor for employment purposes"

These amendments will enter into force ten calendar days after the date of their first official publication.

Key Changes:

  • The list of individuals exempt from the requirement to obtain permits from local executive authorities for the engagement of foreign labor in Kazakhstan has been clarified.

Prior to the amendments:

  • According to subparagraph 16) of Resolution No. 1041, exemption from the permit requirement applied to the first executives and their deputies of Kazakhstani legal entities with 100% foreign ownership.

Following the amendments:

  • The exemption now applies exclusively to one first executive and one deputy of a Kazakhstani legal entity with 100% foreign ownership.

Accordingly, no more than one foreign individual may be exempted for each of the specified positions. The official text of the Resolution can be accessed via the following link.
