On March 29, 2024, it was published in the Official Gazette of Romania the emergency ordinance number 32 for the amendment and completion of the Government Emergency Ordinance no. 27/2022 regarding the measures applicable to final customers in the electricity and natural gas market during the period April 1, 2022—March 31, 2023, as well as for the amendment and completion of some normative acts in the field of energy and the adoption of some measures in the field of energy.
Among the important changes regarding the calculation of the contribution to the Energy Transition Fund (“CET”), we mention:
- for electricity / natural gas producers, for the production activity (which calculates CET according to Annex 6 of the GEO)
- reduction of the reference price for which CET is due from 450 lei/MWh to 400 lei/MWh;
- in case of electricity producers from wind and solar energy, the expenses with imbalances (part of the calculation of monthly expenses) increase from 5% to 10% of the value of electricity with physical delivery from own production;
- for electricity and natural gas producing entities, aggregated electricity producing entities, electricity and natural gas traders, electricity and natural gas suppliers and independent electricity aggregators for the trading activity (which calculates CET according to Annexes 6.1 of the GEO)
- changing the date until which the calculation methodology is applied - from August 31, 2023 to March 31, 2025;
- modifying the meaning of the reference price by increasing the margin from 2% to 10% which is added to the average monthly electricity / natural gas purchase price;
- the mention in the definition of the average purchase price of the fact that for suppliers who carry out trading activity and do not specifically allocate the purchase contracts between the supply activity and the trading activity, the entire purchase made by the suppliers will be taken into account, regardless of the destination of the electricity / natural gas.
