On July 10, 2025, the following European regulations regarding the electronic system for non-customs agricultural formalities were published in the Official Journal of the European Union:
- Regulation (EU) 1269/2025 and Regulation (EU) 1272/2025 establishing the rules for the application of Regulation (EU) No. 1308/2013;
- Regulation (EU) 1271/2025 amending Implementing Regulations (EU) 1239/2016, (EU) 761/2020, (EU) 1988/2020, and (EU) 2834/2023;
- Regulation (EU) 1268/2025 amending Delegated Regulations (EU) 1237/2016 and (EU) 760/2020.
These Regulations establish the rules for the implementation of Regulation (EU) No. 1308/2013 on the common organization of agricultural product markets, replacing paper procedures with the electronic system ELAN (Electronic Local Administrative Notification).
Among the most important aspects, we mention the following:
- The electronic system for non-customs agricultural formalities (“ELAN”):
- It is an independent module from the trade control and expertise system (“TRACES”) and will apply to documents used for fulfilling non-customs formalities necessary for trade with third countries for several categories of products, such as: cereals, dried fodder, wine, tobacco, beef/sheep/poultry meat, agricultural origin ethyl alcohol, vegetables, and fruits;
- It will allow the issuance, transmission, storage, and extraction of certain documents, such as: import and export licenses, authenticity certificates, “IMA1” certificates, origin certificates required for certain tariff quotas;
- Each document made available in ELAN must contain the qualified/advanced electronic seal or the qualified or advanced electronic signature based on a qualified certificate of an authorized representative;
- Starting from January 18, 2027, all licenses will be issued based on the ELAN1L-AGRIM and ELAN1L-AGREX data models, and starting from January 17, 2028, all import and export licenses will be issued or transmitted in ELAN from national electronic systems;
- Applications for licenses will be submitted through the information technology applications provided by the member states. The competent national issuing authorities establish the model or data model that economic operators must use for license applications.
