Reminder of reporting requirements regarding corporate income tax information in the Republic of Moldova (Public CbCR)

Law no. 320 of 9 November 2023 on the amendment of certain normative acts (regarding the filing of income tax information of certain entities), published in the Official Gazette of the Republic of Moldova no. 441 art. 752 of 22.11.2023.

We would like to remind you that for years starting on or after 1 January 2025, special regulations have entered into force in the Republic of Moldova regarding the reporting of the corporate income tax information alongside with the financial statements for certain entities.

Under these rules, companies and branches of multinational groups headquartered outside the Republic of Moldova that meet the criteria set by the legislation (such as entity size and revenue thresholds at the group or individual level) must include in their management report a dedicated chapter regarding corporate income tax information at group level.

The corporate income tax information will include for each entity of the group:

  • a description of the main activities of the entity/entities and the names of the group entities (if applicable);
  • sales revenue;
  • profit (loss) before tax;
  •  corporate income tax expenses;
  • corporate income tax paid;
  • net profit (net loss) of the reporting period;
  • retained earnings (uncovered loss) of previous years.

The statutory auditor’s report will include conclusions regarding the fulfilment of the reporting requirements for the reporting period preceding the period for which the financial statements are audited.

This update is accurate to the best of our knowledge at the time of issue.  It is, however, meant as a general guide and comes with the recommendation that professional advice be sought before any action is taken.
