Peruvian President ratifies Convention to Harmonize the Double Tax Treaties of Pacific Alliance

  • The Peruvian President has ratified the Convention to Harmonize the Double Tax Treaties of the Pacific Alliance countries.

On 29 October 2022, the Peruvian President enacted Supreme Decree 050-2022, ratifying the Convention to Harmonize the Double Tax Treaties of the Pacific Alliance countries (the Convention).

Background

On 14 October 2017, Chile, Colombia, Mexico and Peru signed the Convention that will harmonize the tax treatment of pension funds under the Double Tax Treaties of the Pacific Alliance.

On 5 October 2022, the Peruvian Congress enacted Legislative Resolution 31580 approving the Convention. For information on the approval of the Convention and the main provisions harmonized under the Double Tax Treaties of the Pacific Alliance, see EY Global Tax Alert, Peruvian Congress ratifies Convention to Harmonize Double Tax Treaties of Pacific Alliance, dated 10 October 2022. Following approval by Congress, the Convention was pending ratification by the Peruvian President.

Supreme Decree 050-2022

Ratification of the Convention by the Peruvian President is the final procedure for the domestic approval of international treaties signed by the Government of Peru.

The Peruvian Ministry of Foreign Affairs will publish the Supreme Decree in the Official Gazette, providing the entire text of the Convention and the date of entry into force.
