GST Council recommends export status for Intermediary services

The GST Council has recommended aligning the place of supply for Intermediary services with the recipient’s location, addressing a legacy issue from the service tax era. 

This reform is set to unlock substantial benefits for IT/ITES, back-office operations, and GCCs by enabling such services to qualify as exports. The change is expected to reduce tax exposure, lower litigation risk, and enhance clarity, while also positioning India as a preferred global service delivery hub. 

Taxpayers may need to monitor the legislation closely, as current indications suggest a prospective application, but any retrospective impact may be evaluated once final provisions are notified.
